Terms
These terms cover using countyhistoryarchive.com and buying books from it. The County History Archive is run by PL Photography Limited, trading as Piemags, company number 10803986, Bridgend, Wales. By using the website or buying a book you agree to them. How we handle your personal details is on our privacy page.
1. What you are buying
1.1 Every book on the website was published in the United States before 1931 and is in the public domain there. We claim no copyright in the books themselves.
1.2 When you buy a book you pay for our supply of the complete PDF, the cataloguing and checking attached to it, and its delivery to you through your account.
2. What you may do with a book
2.1 You may read, print and quote from the PDF for your own private, research or teaching purposes, worldwide and with no time limit.
2.2 You may not sell, share or give away the PDF, in whole or in part, or put it where others can download it.
2.3 Publishing pages from a PDF, or any commercial use of it, is priced on application. Email [email protected].
3. Accounts
3.1 You must be 18 or over to make an account or buy a book. Anyone may look at the public pages.
3.2 Keep your password to yourself. You are responsible for what is done through your account, and you must tell us straight away if you think someone else has used it.
3.3 Give us true details. We may suspend or close an account that has been used to break these terms or to misuse the website.
4. Prices and paying
4.1 Prices are in US dollars and are set by the number of pages in the PDF, as shown on the prices table. The price that applies is the one shown when you pay.
4.2 Card payments are taken by Stripe, and your card details never reach us. Any tax due is worked out on the payment page from your billing address.
4.3 We may refuse or cancel an order, for example where a price was shown wrongly or a payment looks fraudulent. If we cancel an order you have paid for, we refund you in full.
5. Downloads
Every book you buy stays in your account. Each download link lasts fifteen minutes, and you can make a new one from your account whenever you need it. The website is occasionally unavailable for maintenance, so keep a copy of every book you buy.
6. Faulty files
If a PDF you have bought is damaged or will not open, and you tell us within 45 days of buying it, we will supply a good copy or refund you.
7. Cancelling
7.1 If you are buying as a private individual, you normally have 14 days to change your mind about digital content. By starting a download you ask us to supply the book straight away and agree that your right to cancel ends once the download has started. This does not affect your rights if a file is faulty.
7.2 If you are buying for a business and have not downloaded the book, you may ask in writing, within 45 days of your receipt, for the order to be cancelled and refunded.
8. What is in the books
8.1 The books are reproduced as they were printed, with the language and views of the people who wrote them.
8.2 The catalogue details, the surname lists and the pictures on each book page are prepared with care. The surname lists are read by machine from the text of each book, so a name can be misread or missed. We correct mistakes when we find them or when they are pointed out to us.
9. Links to other websites
A link to another website does not mean we approve of it or are connected with it. We are not responsible for other websites or for anything you buy from them.
10. What you must not do
You must not use the website to break the law, to harass or defame anyone, to send spam, to give false information, to collect other people's personal details, or to upload anything harmful. You must not try to get round the website's security or its download links, or open parts of it you have not been given access to.
11. Crawling, scraping and data mining
11.1 Search engines and other automated services may read the public pages of the website as our robots.txt file allows.
11.2 Beyond that, you must not use any robot, scraper or other automated tool to copy, download or monitor the website, its catalogue or its surname lists, or carry out text and data mining on them. This is an express reservation of our rights, including under Article 4(3) of Directive (EU) 2019/790. It applies except where the law does not allow us to restrict it.
12. Reporting a problem with a book
If you believe you own rights in something on the website, or that a book should not be here, email [email protected] with a link to the page, what you believe is wrong, and how to reach you. If you are claiming rights, tell us what they are and that you hold them. We take the book down while we look into it, and we tell you what we decide.
13. Our rights
The website's design, text, catalogue, surname lists and database belong to Piemags. Using the website does not give you any right to copy them or to use the Piemags or County History Archive names.
14. Liability
14.1 Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or under your statutory rights as a consumer.
14.2 Subject to 14.1, we are not liable for loss of profits, sales, business, data or goodwill, or for any indirect or consequential loss.
14.3 Subject to 14.1, our total liability to you is limited to the greater of £1,000 and the total you paid us in the 12 months before the claim.
15. General
15.1 These terms, with your receipt, are the whole agreement between us about anything you buy. If any part of them cannot be enforced, the rest still applies.
15.2 We may change these terms. Each purchase is governed by the version shown here on the date of purchase.
15.3 You may not transfer your rights under these terms to anyone else without our written agreement. We may transfer ours to anyone who takes over the archive. No one else has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
15.4 These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute about them. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your own country's courts.
15.5 Questions about these terms go to [email protected].
